Privacy Policy
Introduction
DevEngine Technology Ltd. (the "Company", "DevEngine", "we", "us", or "our") connects companies in Canada, the United States, and Europe with software engineers, data specialists, AI developers, and technical professionals located in Canada and Latin America, by building distributed engineering teams and providing staff augmentation and permanent placement services (the "Services").
The Company respects the privacy of individuals and strives to collect, use and disclose Personal Information in a manner consistent with all applicable laws, including but not limited to the Personal Information Protection Act (British Columbia), the Personal Information Protection and Electronic Documents Act (Canada), and applicable privacy laws in the United States and Europe. The Company is committed to safeguarding the privacy of Personal Information that it collects, uses or discloses in the course of providing the Services and will not sell Personal Information.
Application of Policy
This Policy establishes the Company's obligations and expectations for the use, collection and disclosure of Personal Information of visitors to or registered users of the Company's website at www.devengine.ca (collectively, the "User" or "Users" as applicable)—whether oral, electronic or written. This Policy applies to both:
Clients: Companies seeking to hire technical talent through our Services;
Engineers/Talent: Technical professionals seeking employment opportunities through our platform
This Policy does not apply to the Personal Information of the Company's employees or contractors engaged directly by DevEngine.
Personal information
In this policy, "Personal Information" means any information about an identifiable individual but does not include business contact information which enables an individual at a place of business to be contacted. Information that is organized in the aggregate and/or which does not reasonably identify the individual to whom it pertains is not Personal Information.
Purposes
Except as otherwise provided by law, the Company shall collect, use or disclose Personal Information only as reasonably required for providing the Services (the "Purposes"). The Purposes include, but are not limited to:
facilitating the interactions between Clients and Engineers/Talent through email, phone, SMS, or video conferencing;
managing the accounts of registered users, including billing and payment processing;
notifying Engineers/Talent of new and upcoming relevant job opportunities that match their skills and experience;
presenting Engineers'/Talent's profiles, resumes, and technical assessments to Clients for specific job opportunities;
facilitating job interviews, technical assessments, and hiring processes between Clients and Engineers/Talent;
coordinating hardware procurement, configuration, and shipping for nearshore team members, including collecting shipping addresses and IT security requirements;
managing contract staffing arrangements, permanent placements, and staff augmentation services;
improving the delivery of the Services, including providing customer support;
monitoring the use of the Company's website, for creating, improving or editing the Company's website content, and to protect the security and integrity of the Company's website;
enforcing the User's compliance with all applicable terms of use and all applicable laws, including investigating any complaints or claims related thereto or assisting law enforcement or any authority with jurisdiction in any investigation;
providing Users with notifications relating to the Services, including notifications from other Users, updates about changes to, and features of, the Services, important news which may impact a User's use of the Services, and as may be required by law;
complying with the Company's legal obligations, business requirements, and regulatory compliance requirements (including those in Canada, the United States, Europe, and Latin America) and for auditing purposes; and
facilitating cross-border employment arrangements and ensuring compliance with immigration, tax, and employment laws in applicable jurisdictions.
If the Company wishes to use or disclose Personal Information for any purpose other than the Purposes, the Company will obtain the consent of the User, as required under applicable laws and regulations.
Consent
By visiting the Company's website, or by voluntarily providing Personal Information to the Company in the course of becoming a registered user or engaging with our Services, as applicable, the User is deemed to have given his or her consent to the collection, use and disclosure of Personal Information under this Policy.
For Engineers/Talent:
By submitting your information to DevEngine, you consent to having your profile, resume, and relevant qualifications shared with potential Clients for specific job opportunities. We will only present your information to Clients for positions you have expressed interest in or that match your stated preferences.
For Clients:
By engaging our Services, you consent to sharing your company information, hiring requirements, and project details with potential Engineers/Talent candidates as necessary to facilitate the recruitment and placement process.
A User may withdraw his or her consent in writing to the use and disclosure of their Personal Information at any time, subject to legal or contractual restrictions and reasonable notice. Such withdrawal may be submitted to contact@DevEngine.ca. If a User withdraws consent to the use and disclosure of Personal Information, it may compromise the Company's ability to provide the User with the Services.
Collection of Personal Information
The types of Personal Information that the Company may collect include, but are not limited to, the following:
From All Users:
email address, postal code, first and last name, cell phone number, physical address;
information related to the use of the Company's website, including IP address, browser type, the referring domain, pages visited, and search history;
information relating to the User's interactions with the Company, including records of correspondence, internal notes or memoranda, financial records, and business records.
From Engineers/Talent:
resume, portfolio, work samples, and professional references;
technical skills, certifications, and educational background;
work authorization status and location preferences;
salary expectations and availability;
results from technical assessments and interviews;
banking information for payment processing (for contract engagements);
shipping addresses for hardware delivery (for nearshore placements).
From Clients:
company information, including incorporation details and business registration numbers;
billing information, including GST/HST numbers or equivalent tax identifiers;
hiring requirements, technical stack information, and project details;
IT security policies and hardware configuration requirements;
interview feedback and hiring decisions.
The Company normally collects Personal Information directly from the User but may collect User's Personal Information from third parties as authorized by law, including from professional references, previous employers (with consent), or publicly available sources such as LinkedIn or GitHub profiles.
Disclosure of Personal Information
The Company may disclose Personal Information to third parties for legitimate business purposes or the Purposes and will obtain assurances from such third parties that they will safeguard Personal Information in a manner consistent with this Policy.
Cross-Border Disclosures:
Personal Information may be disclosed to third parties located in Canada, the United States, Europe, and Latin America (including Argentina, Brazil, Colombia, Chile, Mexico, and Costa Rica) as necessary to provide the Services. To the extent Personal Information is disclosed to third parties in other countries, those countries may or may not have laws that seek to preserve the privacy of Personal Information to the same extent as Canadian privacy laws. By using our Services, you consent to such cross-border transfers of Personal Information.
Third-Party Service Providers:
The Company uses services hosted by third parties in the course of providing the Services, including but not limited to:
Applicant tracking systems and recruitment platforms
Cloud hosting services (e.g., Amazon AWS, Microsoft Azure, Google Cloud)
Payment processing services
Video conferencing and communication tools
Hardware procurement and shipping vendors
Background check and verification services (including Certn and other screening providers)
To the extent any third-party service provider collects the Personal Information of Users, such collection will be subject to the applicable privacy policies of those third-party providers and the Company will ensure such providers maintain appropriate data protection standards.
Background and Reference Checks:
For Engineers/Talent being considered for placement with Clients, the Company may engage third-party screening services (such as Certn) to conduct background checks, employment verification, reference checks, and credential verification. These checks are conducted with the Engineer's/Talent's consent and may include sharing Personal Information such as employment history, educational credentials, references, and other information necessary to verify qualifications. Results of these checks may be shared with the prospective Client as part of the hiring process.
Sharing Between Clients and Engineers/Talent:
As part of facilitating the recruitment and placement process, DevEngine may share relevant Personal Information between Clients and Engineers/Talent, including but not limited to: profiles, resumes, technical skills, project requirements, interview feedback, and other information necessary for the hiring and engagement process. Such sharing is done only with the express consent of the relevant party and in accordance with the purposes outlined in this Policy.
Retention and Destruction
Subject to the terms of this Policy, Personal Information is only retained as long as is reasonable to fulfill the purpose for which it was collected or for legal or business purposes (such as backup, archival, or audit purposes, or to improve the Services) or as otherwise required under applicable law.
Personal Information which is used to make a decision that directly affects the User to whom it pertains will be retained for at least one year after the date of that decision, or longer as required by applicable employment, tax, or business laws.
The Company implements secure deletion practices when Personal Information is no longer required, including secure erasure of electronic files and secure destruction of physical documents.
Security
The Company will take reasonable precautions, including technical, administrative and physical measures to protect Personal Information from loss, misuse, and unauthorized access, disclosure, alteration or destruction. These measures include:
Encryption of data in transit and at rest
Access controls and authentication requirements
Regular security assessments and updates
Employee training on data protection and privacy
Secure facilities and locked storage for physical records
Incident response procedures
Records containing Personal Information are considered Company property and will be afforded confidential treatment at all times, regardless of whether these records are in electronic or paper form.
While we implement industry-standard security measures, no method of transmission over the Internet or electronic storage is 100% secure. Users acknowledge that they provide Personal Information at their own risk.
Accuracy
The Company will employ reasonable efforts to keep Personal Information relevant to its intended use, accurate, complete and current. The Company relies on Users to notify it if there is a change to their Personal Information.
The Company will take reasonable steps to permit Users to correct, amend or delete Personal Information that is demonstrated to be inaccurate or incomplete. These requests may be made by contacting us at contact@DevEngine.ca.
In the event Personal Information is corrected, the Company will as soon as reasonably possible send applicable corrections to each organization the Personal Information was disclosed to during the year before the Personal Information was corrected. In the event Personal Information is not corrected, the Company will note the requested correction where applicable.
Access
Users have a right to access their Personal Information that is in the custody or under the control of the Company, subject to exceptions provided for in applicable privacy laws. In the event an access request is refused, the User will be advised in writing of the reasons for the refusal and other applicable information.
Users also have a right to ask the Company to provide them with information about how their Personal Information has or is being used, as well as with the names of the individuals and organizations to which a User's Personal Information has been disclosed.
Any requests for access or information about how Personal Information has been used and to whom it has been disclosed should be made in writing to contact@DevEngine.ca. The Company may charge Users a minimal fee for access or information requests to cover administrative costs.
International Data Transfers
Given the international nature of our Services, Personal Information may be transferred to, stored, and processed in countries other than the country in which it was collected. These countries may have different data protection laws than your jurisdiction. By using our Services, you consent to such transfers.
For users in the European Union, we ensure that appropriate safeguards are in place for transfers of Personal Information outside the EU, in accordance with applicable data protection laws.
Your Rights
Depending on your jurisdiction, you may have additional rights regarding your Personal Information, including:
The right to request deletion of your Personal Information (subject to legal and contractual obligations)
The right to object to certain processing activities
The right to data portability
The right to lodge a complaint with a supervisory authority

This Policy may be amended from time to time, consistent with the requirements of applicable law. For material changes, we will provide appropriate notice to Users, which may include email notification or a prominent notice on our website. Your continued use of the Services after any changes indicates your acceptance of the updated Policy.
